Direct Support Professional Legislative Update May 2005
There are two bills related to DSP issues being considered by the LA State Legislature in the 2005 session. House Bill (HB) 697 and Senate Bill (SB) 271.
House Bill 697 would allow DSP to perform tasks authorized by registered nurse.
- There are two bills related to DSP issues being considered by the LA State Legislature in the 2005 session. House Bill 697 provides for the performance of certain tasks by direct service workers in an individual’s residence. This bill would permits direct service workers employed by a licensed agency to perform tasks authorized by a registered nurse for individuals receiving supports in their homes, such as: administration of medication, ointments, suppositories, pre-measured dosage unit of oral inhalant, and hydration, nutrition, medication, via g-tube. The proposed legislation would require six hours of training for each support staff from a registered nurse in the home of the individual receiving support services.
- As of May 16, 2005 this bill was passed by the House of Representatives and was sent to the Senate. The Senate has assigned the HB 697 to the Senate Health and Welfare Committee for review.

Senate Bill 271 establishes a direct care worker registry. “click here for more info” button and have it connect to the following:
- This legislation would establish a direct support worker registry or database to identify minimum standards (of training) and a criminal history check of direct care workers. The legislation clarifies the definition of a direct care worker would allow the Department of Health and Hospitals to begin the development of rules and regulations about maintenance of the direct care worker registry.
